Terms
These terms are between you, the business owner who signs up, and Collin Mallery ("I", "me"), a website designer in Reno, Nevada. You accept them when you check the box and start your plan. If you sign up for a business, you confirm you're allowed to agree to them for it.
1. What I do
- I design and build a website for your business, host it, keep it secure, and give you a dashboard to update your hours, services, photos, announcements and team.
- Live within a week. Your site goes live within 7 days of the day you finish signing up. If I need something only you can give me (like your logo, photos, or access to your domain), I'll tell you by email, and the days until I have it don't count. If I miss the date, your next month is free: a credit for one month of your plan's price on your next bill, or, if you're on a free month, a free month that's a month longer.
- Changes you make yourself in the dashboard are unlimited.
- Changes I make for you. Your plan includes 2 change requests a month, sent from Request a change in your dashboard. I usually finish each one within 3 business days. With the Priority add-on, you get 6 a month, usually done the next business day.
- Bigger work, like new pages, new features or a redesign, is quoted first. I don't start it, or charge for it, until you approve the quote.
- Your plan, its price and any add-ons are shown in the summary you confirm at signup.
2. The preview
- I build a preview of your site before you pay anything. You don't owe anything for a preview you decide not to keep.
- The preview uses facts from your business's public listings until you give me other information.
3. Payment
- Setup fee. If your plan has a setup fee, it's charged once, when you confirm your plan. If it was waived or discounted, the summary you confirm shows that.
- Monthly plan. Your plan renews every month on the date shown at signup (or a later start date we agree on) until you cancel. Add-ons you choose are added to the same monthly bill.
- Yearly billing. You can pay yearly instead. A year costs the yearly price shown at signup (right now, 10 months' price for 12 months), for your plan and any monthly add-ons; setup fees are the same either way. It renews every year until you cancel, and I'll email you before each renewal. Discount codes that take money off the monthly price don't apply to yearly billing.
- Price changes. I can change my prices at any time, including for existing plans and add-ons, and I'll always email you before a new price applies to you. For your plan, you get at least 30 days: a higher plan price starts with your first bill at least 30 days after that email (on yearly billing, your first renewal at least 30 days after it). A lower plan price starts with your next bill. A new add-on price starts with your next bill after the email. If you don't want to continue at a new price, you can cancel online before it starts.
- Cards. Payments are processed by Stripe. I never see or store your full card number.
- Backup card. If you add a backup card and a charge to your primary card fails, the same charge is made to your backup card so your site stays online. You'll get an email when that happens.
- Late payments. If a payment fails and there's no working backup card, Stripe retries it over about two weeks and I'll email you. If your account is still unpaid 10 days after the first failed payment, I'll email you a warning. If it's still unpaid after 14 days, your site is paused: visitors see a "temporarily unavailable" page with your business phone number. Your dashboard stays open so you can update your card, and your site comes back on its own as soon as the balance is paid. If your site stays paused for 60 days, I may remove it and its data after emailing you notice.
- Discount codes apply only as described when you use them.
- Refunds. The setup fee and your first month aren't refundable, and neither are one-time charges such as an add-on's setup or a domain registration. After your first month, if you cancel, you can ask me to refund the unused days of the month you're in, and I'll refund them to your card. Yearly billing isn't refundable: if you cancel, your site stays up through the end of the year you've paid for.
4. Canceling
- You can cancel any time from Billing in your dashboard. No call needed.
- Your site stays up through the end of the month (or, on yearly billing, the year) you've paid for, then goes offline.
- Your data after you cancel. For 30 days after your plan ends, you can still sign in and download your content (business info, services, photo list, quote requests and more) from Export in your dashboard. After that, I delete your site and its data. Copies in my backups expire within another 30 days.
- Your domain. Your domain name is yours. If you leave, I'll help you move it wherever you like at no charge.
5. Your content and your domain
- You own your business name, logo, photos, text and the information you enter. You give me permission to use them to build, host and show your website.
- I may show your site in my portfolio. If you'd rather I didn't, tell me and I'll take it out.
- You're responsible for making sure you have the right to use anything you upload, and that what's on your site (prices, claims, hours) is accurate. I don't add prices, reviews, certifications or warranties on your behalf.
- If you already own your domain, you keep it. If I register one for you, it's registered in your business's name and it's yours.
6. My work
- I own the design, code and templates I make for your site, and you may use them for as long as your plan is active.
- Buying your site. If you'd like to own your site's design and code outright (for example, to host it somewhere else), ask me for a buyout quote. Once it's paid, I'll hand over the site files and your data and help you move your domain.
7. Acceptable use
You agree not to use the site, the dashboard or the quote form for anything illegal, deceptive or harmful, or to try to access other customers' sites or data. I may suspend a site that's being used that way.
8. Availability and security
- I host on Cloudflare and work to keep your site fast, available and secure, and I keep regular backups. But I can't promise it will never be down, and I don't offer an uptime guarantee or service credits.
- Keep your password private and turn on two-factor sign-in under Account. You're responsible for what happens under your login and your team members' logins.
- Quote requests and bookings from your site are stored so you can see them in your dashboard, and emailed to the owners on your account.
9. Privacy
How I handle information sent through collinmallery.com is described in the privacy notice. Visit counts on your site are daily totals only, with no cookies or personal data.
10. Liability
- I provide the website and dashboard "as is." To the extent the law allows, I'm not liable for indirect or consequential losses, such as lost profits or lost business.
- My total liability for any claim about my services is limited to what you paid me in the 12 months before the claim.
- You'll cover claims brought against me because of content you provided or how you used your site.
11. Changes to these terms
If I change these terms, I'll email you at least 30 days before the change takes effect. If you don't agree, you can cancel before then. Price changes follow "Price changes" in section 3.
12. Nevada law
These terms are governed by the laws of the State of Nevada. Any dispute will be handled in the state or federal courts in Washoe County, Nevada.
